We want our users to fully understand what information we collect, how we use this information, and the steps we take to protect your personal information. Please read this Privacy Policy to learn more about the policies and procedures we have put in place to achieve this goal. By using TLCH Foods, Inc.’s services and this Website, you are consenting to the tracking, recording, collection, storage, and processing of your personal information pursuant to this Policy. We collect any information you voluntarily enter on our Site or that you provide to us in any other way. This personal information is submitted to us by you in a variety of ways including, but not limited to by creating or registering for an account on our Site, sending us an email or a request to be contacted, signing up for our email list, signing up for special offers or contest sponsored by us, one of our partners, or selected third-parties, or by submitting your credit card or other payment information when ordering or purchasing products and/or services through our Website. By providing your personal information, you represent that you have the right to communicate or disclose the information submitted. Please do not submit the personal information belonging to another without their consent.

Personal Information

The personal information collected from you includes personally identifiable information such as your first and last name, email address, mailing address, credit card or payment information, and phone number. It may also include, but is not limited to, other information related to servicing your meal subscription, such as product or services purchased or viewed, your weekly meal choices, food preferences, preferred delivery day, and meal feedback.

Financial Data

Financial information, such as data related to your payment method (i.e., valid credit card number, card brand, expiration date, billing zip code), that we may collect when you purchase, order, return, exchange, or request information about our products or services from the site. We store only very limited, if any, financial information we collect. Credit card data is tokenized and held by a certified third party. Otherwise, all financial information is stored by our payment processors.  These third-party companies we use maintain their own secure sites and use encryption and other security measures to safeguard your personal information.

Data from Contest and Giveaways

Personal and other information you may provide when entering contests or giveaways and/or responding to surveys.

We may use your information to provide basic functionality on our Site, such as displaying appropriate meal recommendations, processing and fulfilling your meal subscription or orders, communicating about orders and their status, and personalizing the customer experience where possible.

We may also use your information to contact you for informational or promotional purposes and to provide customer service to you. We may also use your personal information for analytical purposes to monitor web traffic and keep track of web pages our users visit within our Site in order to determine what services or web pages are the most popular and to analyze trends and user behavior to help improve our Site and user experience.

We may use non-personally identifiable information collected to determine user demographics, interests, and behavior, and may market TLCH Foods, Inc. products using this information or by sharing it with partners. TLCH Foods, Inc. may also provide your non-personally identifiable information to contractors so that they can perform services for us, such as IT or analytics. Legal Requests

We cooperate with law enforcement authorities, as well as with other third parties, to enforce laws and intellectual property rights, and to prevent fraud. In response to a verified request by law enforcement, court order, or other government officials relating to a criminal investigation or alleged illegal activity, we can, and you authorize us to, disclose your email address, login history, fraud complaints, and site use history, with or without a subpoena. Without limiting the above, we will not disclose your personal information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to protect our rights or to prevent imminent physical harm, financial loss or to report suspected past, present, or future illegal activity. Third Party Service Provider

Sale or Bankruptcy

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity.  If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party.  You acknowledge that such transfers may occur and that the transferee may decline to honor commitments we made in this Privacy Policy.

4. How We Protect Your Information.

The security of your personal information is important to us. When you provide sensitive information (such as a credit card number), we encrypt that information using a TLS 1.3 encrypted connection. We follow generally accepted industry standards to protect the personal information submitted to us, during transmission, and once we receive it.

We use administrative, technical, and physical security measures to help protect your personal information. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee the absolute security of such information. Children

The Site is not intended for use by children. We do not knowingly solicit information from or market to children under the age of 16. If you become aware of any data that we have collected from children under the age of 16, please notify us.

5. Options Regarding Your Information.

Account Information

You may review or change the information in your account or terminate your account by emailing customer support. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases.  However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with investigations, and enforce our Terms of Use.

California Privacy Rights

California Civil Section 1798.83 permits California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the name and addresses of all third parties for direct marketing purposes in the immediately preceding calendar year.  If you are a California resident and would like to make such a request, please submit your request in writing to our support department.   Please be aware that although publicly facing data may be removed, the data may not be completely or comprehensively removed from our systems.

If you are under 18 years old and reside in California, and have a registered account with this Site, you have the right to request removal of unwanted data that you publicly post on the Site.  To request the removal of such data, please contact the support department.

6. Consent

By using our website, you consent to the collection and use of your personal information as described in this Privacy Policy.

7. Changes to Privacy Policy.

If our Privacy Policy or procedures change, we will immediately post those changes to our website. Any such changes will be effective thirty (30) days from the time such new policies are posted, unless otherwise stated in the change. It is your responsibility to review this Privacy Policy for any changes.

TLCH FOODS, INC. PRIVACY POLICY GDPR ADDENDUM

Effective Date: This GDPR ADDENDUM (“Addendum”) is effective July 1, 2020.

As noted in our Privacy Policy (the “Policy”), which this Addendum supplements, our services and Website are not intentionally directed at individuals outside the United States. Out of an abundance of caution, to the extent personal information may be collected from within the European Economic Area (“EEA”) to which the General Data Protection Regulation (“GDPR”) applies, that personal information (for this Addendum and Section IX(3) of the Policy, as defined in the GDPR) will be governed by the GDPR, and this Addendum, which will, as to that information, take precedence over anything to the contrary in the Policy.

If you have questions about or wish to exercise any privacy rights pursuant to this Addendum or the Policy, or otherwise under applicable law (whether or not referred to in the Policy), or wish to correct your personal information, contact us using the information in Section II of the Policy.
